Regular Town Board Meeting Minutes

7:00p.m.—8:44p.m.

Town Officials Present:  Supervisor—Acting Chairman:  Michael Poe,
Supervisors: Rosetta Boyle, Steven Gillespie, and David Specht.
Town Official Absent:  Chairman:  William Jax
Others Present:  Clerk/Treasurer: Betty Manson, Assistant
Clerk/Treasurer:  Marion Uphoff (arrived at 7:30p.m.), Zoning
Administrator:  William Bruce, Town Worker:   Dick Martin, Town
Officer:   Tony Green (arrived at 7:30p.m.), Town Attorney:  William
Curran (arrived at 7: 10p.m.) and approximately 10 guests.  

Supervisor Poe stated that due to a medical issue with Chairman Jax,
and as per designation by Chairman Jax, he will chair this meeting   

CALL MEETING TO ORDER:  Supervisor Poe called the regular monthly
board meeting to order at 7:00p.m. 

PLEDGE OF ALLEGIANCE:  Pledge of Allegiance was recited by all
present.

VERIFICATION OF PROPER POSTING:  Manson verified that this meeting had
been properly posted at 4 locations within the Town and this agenda
was published in “The Messenger” on June 3, 2010.

APPROVE AGENDA IN ANY ORDER:  Poe stated that due to public concerns
with the Liquor Licenses, he would like the board to modify the agenda
order, to have 2 public comment areas, the first one after the
Treasurer’s Report—which will only be pertaining to the subject of
Liquor Licenses.  The other public comment will be after the Vouchers
as usual.  Motion was made by Boyle to approve the agenda with 2
public comment areas, 2nd by Poe.  Motion Carried.

MINUTES:   Motion was made by Boyle to approve the minutes of the
Board of Review meeting (to adjourn to set date) held on May 11, 2010,
Public Hearing held on May 11, 2010, Regular monthly board meeting
held on May 11, 2010, and special board meetings held on May 13, 2010,
and June 4, 2010 as written,  2nd by Gillespie.  Motion Carried.  

TREASURER’S REPORT—BANK RECONCILIATION REPORT—BUCKHORN ACRES PROPERTY
OWNER’S, INC/MORRO’S MILE INC. REPORT:  Manson read the following
monthly financial statement:

Outstanding checks—totaling $27,549.85
Poe stated that he had reviewed and reconciled with the bank
statements and is in agreement with Clerk/Treasurer on 06/04/2010, Poe
also stated that he has reviewed the checks, checking who the check
was made out to and verifying the amount and he reviewed the
endorsements of the cancel checks, and all were correct.   Motion was
made by Poe to approve the treasurers and reconciliation reports as
presented, 2nd by Specht. Manson stated that there is one outstanding
check that she has concerns of why it hasn’t been cashed.  Check
#14415 to Necedah Fire and Rescue in the amount of $25,368.50 dated
03-09-2010.  Gillespie will contact the Necedah Fire Dept in regards
to this check.  Motion Carried. Poe read Buckhorn Acres Property
Owner, Inc and Morro’s Mile Inc. monthly financial reports for the
month of May 2010.  Motion was made by Poe to approve the Buckhorn
Acres Property Owner, Inc financial report dated May 31, 2010. 
Income: $120.00; Disbursements: $0.00—Balance:  $470.28—no outstanding
checks and Morro’s Mile Inc. financial report dated May 31, 2010. 
Income:  $0.16; Disbursements:  $210.00—Balance:  1,811.75, no
outstanding checks, 2nd by Gillespie.  Motion Carried.

Attorney Curran arrived at 7:10p.m.

PUBLIC COMMENT:  Andy Suehs:  What are the requirements to be a
resident of Wisconsin? He stated that the owner of Buckhorn Café does
live in Wisconsin and has Illinois license plates.  Buckhorn Café is
incorporated in City of Mauston.  Jan Brendle:  She sees problems with
Buckhorn Café serving outside.  She and her dogs have threatened.  She
also stated that Volleyballs are coming onto to property all of the
time.  Brad Pavloski:  Would like to see a privacy fence between
Buckhorn Café and the Brendle property.  Sharon Jones:  Can the board
put restrictions on the noise after hours?    

APPLICATION FOR WHOLE SALE BEER LICENSE AND FEE:  Motion was made by
Poe that the license for Wholesale Beer License shall be $25.00 per
year per state statute 125.28(4), 2nd by Boyle.  Motion Carried. 
Motion was made by Poe to award a Wholesale Beer License to Ranei M
Johnson Scholler and Edward Scholler d/b/a Woodfield Distribution,
LLC, 2nd by Boyle.  Motion Carried.

LIQUOR LICENSES:  CLASS A, CLASS B, CLASS “B” AND CLASS C/OPERATOR’S
LICENSES/CIGARETTE LICENSES/SODA LICENSES:  SEE ATTACHED LIST:  Motion
was made by Boyle to approve the following Class A Combination Liquor
Licenses—July 1, 2010—June 30, 2011: Horst E. Hartmann d/b/a Bavarian
Campsite W4796 County Road G, Mauston; Wendy A. Navis d/b/a The
Landing N6243  County Road G  Mauston; Ronald A. Pocevicz  Jacqueline
L. Pocevicz d/b/a Germantown Junction Store  N7010 State Road 58, New
Lisbon, 2nd by Gillespie.  Motion Carried.  Motion was made by Specht
to approve the following Class B—Beer Liquor License:  Donna Case
d/b/a Fresh and Frozen Seafood    N6828 State Road 58, New Lisbon with
the clarification of seller’s permit number, 2nd by Boyle.  Motion
Carried.  Motion was made by Poe to approve the following Class B
Combination Liquor Licenses—July 1, 2010—June 30, 2011:  Cutler
Amusement Corp.  agent Stella B. Hysell d/b/a Kozy’s Pizza N6897
County Road G, Mauston; Irvin E. Tessmer, agent Jason Rodebaugh, d/b/a
Pine Cove W5151 38th Street , New Lisbon; The Dirty Turtle LLC, agent 
Sheila A. Marx d/b/a Dirty Turtle W5250 N. Osprey Drive, New Lisbon;
South Shore Operations, LLC, agent Dave Andraska d/b/a  South Shore
N6895 Ridgewater Drive, Mauston; C& B Investments Jack Hall, agent
Daniel M. Berkos  d/b/a Shipwreck Bay N7265 Shacks Road, Mauston;
James Collis d/b/a Buckhorn StoreN8414 County Road G, Necedah, 2nd by
Gillespie.  Motion Carried.   Poe stated that Buckhorn Café’s Liquor
License was incomplete, #1. Federal ID Missing.  #2.  No Wisconsin
Driver’s License (issued June 4, 2010) #3.  Verify residency.  Manson
stated that she has received 2 outstanding whole sale liquor bills in
regards to Buckhorn Café and Buckhorn Café also has outstanding
personal property taxes due. Motion was made by Poe to approve a Class
B Combination Liquor License—July 1, 2010—June 30, 2011 to JJM Corp of
Mauston, Jaroslaw Szczepaniak d/b/a Buckhorn Café N8404 19th Avenue,
Necedah with the following conditions:  No Outdoor sales, Solid fence
in place.  Poe withdrew this motion.  Motion was made by Poe to
approve a Class B Combination Liquor License to JJM Corp of Mauston,
Jaroslaw Szczepaniak d/b/a Buckhorn Café N8404 19th Ave., Necedah with
the following conditions:  No outdoor service West of the building
(East only of the building).  7’-8’ solid wood fence with volleyball
net (overall height shall be 12’) between neighboring property owner
and volleyball court and contingent to having the liquor license
application completely filled out and all outstanding debts paid and
all proof to the Clerk, 2nd by Specht.  Motion Carried.  Motion  was
made by Specht to approve the following operator’s licenses—July 1,
2010—June 30, 2011:  40 et 8 temporary—Lee Ormson; Buckhorn
Cafe—Jessica Bilski; Kathy Bye; Donnette Denman, Buckhorn
Store—Heather Collis; Alyssa Grams; Karen Kembel; Germaine Reed; Loren
Smith; Ashley Vruble, The Dirty Turtle—Samantha Brodbeck; Erika
Cattle; Daniel(Paul) Graf; Leslye Keltner; Cassie Nauman; Clark
Nauman; Brielle Oliver; Tasha Steen; Bonnie Tully, Fresh and Frozen
Seafood—Gerald Bolda; JoEllen Bolda, Kozy’s Pizza—Patrick McGregor;
Annie Rozinski; Tanya Schultz, Pine Cove—Natasha Croissant; Eden
Spirelli; Melissa Sweeney, Shipwreck Bay—Jamie Bartlett; Brittany

Siddall and South Shore—Cody Brokopp, 2nd by Boyle.  Motion Carried. 
Motion was made by Poe to approve an operator’s license—June 8,
2010—June 30, 2010 for South Shore—Kathleen Anderson.  Poe withdrew
this motion.  Motion was made by Poe to approve an operator’s
license—June 8, 2010—June 30, 2010 for South Shore—Katherine Anderson,
2nd by Gillespie.  Motion Carried.  Motion was made by Boyle to
approve the following Cigarette and Tobacco Products Licenses (Over
the Counter)—July 1, 2010—June 30, 2011:  Bavarian Campsite; Buckhorn
Store; Germantown Junction Store; The Landing; Pine Cove; and South
Shore Operations, LLC, 2nd by Specht.  Motion Carried.  Motion was
made by Boyle to approve the following Non-Intoxicating Beverage
Licenses—July 1, 2010—June 30, 2011:  Bavarian Campsite; Buckhorn
Café; Buckhorn Store; The Dirty Turtle; Fresh and Frozen Seafood
Company; Germantown Junction Store; Kozy’s Pizza; The Landing; Pine
Cove; Shipwreck Bay; and South Shore Operations, LLC, 2nd by Specht. 
Motion Carried.   


COMBINING SANITARY DISTRICTS #1 & #2:  Poe asks Attorney Curran if
Sanitary District #1 can dissolve Sanitary District #2?  Curran will
look this over and suggested to continue to leave this item on the
agenda. Tabled.

ALLIANT ENERGY UPDATE:  Bruce reported that Alliant Energy plans to be
in Germantown late summer/early fall.  Come down 37th Street to
include Waterstone Castle Rock Shores, Stone Gate, Half Moon Bay, down
17th Avenue to include the Harbor, O’Dell’s Bay, Bay View Estates, and
3 Rivers.  They will not go down 38th at this time.  Bruce also
reported that Developers are paying Alliant Energy to bring through
the town.  

COMMITTEE REPORTS: 

LAW ENFORCEMENT REPORT:  Officer Green reported that he is now full
time in Germantown.  Calls are picking up, had damage to public
property (Stop sign) and the 30th Street Road damage.
EMERGENCY MANAGEMENT REPORT:  Bruce had nothing to report this month.
PARK REPORT: Boyle reported that she is awaiting word from the DNR
grant for Brendle Park.  Town Community Center/Town Hall parking lot
should be paved soon, and will look into stripping the parking lot.
ROADS REPORT:   Town will again send a letter to property owners on
41st Street, to make them aware of the extensive road construction
that will be done on that road in July.
OPEN BIDS FOR SEAL-COATING AND CRACK-FILLING ON VARIOUS ROADS WITHIN
THE TOWNSHIP WITH POSSIBLE APPROVAL:  The following seal-coating bids
were opened by Gillespie and read by Poe: 
Scott’s Construction—$41,159.65 to do the following roads:
Sunny Lane—17th to Cul-du-sac 1,000’ x 22’ Single seal—$3,053.40
19th Avenue—Cty Rd G to 43rd St. 4,450’ x 22 Single seal—$13,587.65
Meadow Dr & Cherokee Circle 2,750’ x 20 Single Seal/Black
Slag—$8,396.90
30th Street—Cty G to 19th St 5,280 x 20 (Patch frost cracks with mix
single seal—$16,122.00                                         The
following crack-filling bids were opened by Gillespie and read by
Poe:
Scott’s Construction—$2,940.00 to do the following roads:
Meadow Drive and Cherokee Circle 700’ Route and rubber—$525.00
29th Street—Cty G to Boat Landing 2,100’ Route and rubber—$735.00
19th Avenue—Cty G to 43rd  700’ Route and rubber—$280.00
Shacks Road—Cty G to end 1,000’ Route and rubber—$1,400.00            
                                                      Motion was made
by Poe to accept Scott’s Construction for Seal-coating the above
various roads, eliminating 30th Street, but allowing $2,000.00 to fix
the dips and $1,000.00 to crack-fill on 30th Street, for a total of
$28,037.95 and to accept Scott’s Construction for crack-filling the
above various roads for a total of $2,940.00, for a grand total of
$30,977.95, 2nd by Gillespie. Poe amended this motion, to also include
contingent to Scott’s Construction having bid bonds and insurance
certificates, 2nd by Gillespie.   Motion Carried.
BUILDING REPORT:  Poe stated that there was an Open House held for the
new maintenance buildings on June 5, 2010 and approximately 50-60
people attended.  He thanked the town employees for their extra work
they did in preparation for the Open House.  Poe also stated that he
is waiting for the punch list on the maintenance building.
ZONING ADMINISTRATORS REPORT:  
BUILDING PERMITS:  Bruce reported 9 building permits issued: 10-25 and
10-33.
PLANNING COMMISSION RECOMMENDATION TO APPROVE 3RD ADDITION TO STONE
GATE LAKE;  Bruce reported that the Planning Commission has reviewed
the 3rd Addition to Stone Gate Lake and recommends approval to the
Town Board the changes:  Overall density remains the same. Motion was
made by Specht to approve the changes of the 3rd Addition to Stone
Gate Lake as recommended by the Planning Commission, 2nd by Boyle. 
Motion Carried. 
RESOLUTION 2010-05:  RESOLUTION AMENDING PUD #8 OF HIGH RIDGE: 
Resolution 2010-05 Amending PUD #8 of High Ridge: Bruce stated that
the approved changes are needed to approve the roads, Intensity will
remain the same.  Motion was made by Poe to adopt Resolution 2010-05: 
Resolution Amending PUD #8 of High Ridge, 2nd by Specht.  Roll Call
taken by Manson:  Specht—Aye; Boyle—Aye; Gillespie—Aye; and Poe—Aye. 
Motion Carried.  
VOUCHERS:  Motion was made by Boyle to approve 54 checks #14536 thru
#14589 and 2EFT #2010-11, and 2010-12—totaling 42,961.75  from the
checking account, 1 check #600  totaling $10,000.00  from money market
account, 2nd by Specht.  Motion Carried.   

PUBLIC COMMENT:  Jim Collis:  Brochures are out regarding the starting
up of a canoe route.  Brad Pavloski:  Enjoyed the Open House, he
thinks that putting up a fence by Buckhorn Café is a great idea. Andy
Suehs:  Recommends to board members to take a look at prohibiting
residential rental properties. Specht:  Planning Commission meeting
every month (the day after the regular monthly board meetings) Sharon
Jones:  What now are the requirements for short-term rentals in the
Town of Germantown?  

ADJOURN MEETING:  Motion was made by Specht to adjourn the regular
monthly town board meeting at 8:44p.m., 2nd by Gillespie.  Motion
Carried. 

Supervisor Poe declared the regular monthly town board meeting
adjourned.
