Special Town Board Meeting
						
March 10, 2009
6:48p.m.—7:05p.m.

Town Officials Present:  Chairman: William Jax, Supervisors: Rosetta
Boyle, Steve Gillespie, Michael Poe, and Dave Specht.
Town Officials Absent:  None.
Others Present:  Clerk/Treasurer: Betty Manson, Assistant
Clerk/Treasurer: Marion Uphoff, Zoning Administrator: William Bruce,
Assistant Town Worker:  Gary Ernsting, Owner of Lulich Landscaping,
LLC: David Lulich, Plumber:  Adam Thompson and approximately 6 guests.
 

CALL MEETING TO ORDER:  Jax called the special board meeting to order
at 6:48p.m.

VERIFICATION OF PROPER POSTING:  Manson verified that this meeting had
been properly posted at 3 locations.  Bruce verified that the public
hearing/board meeting was also published in The Messenger.

HOLDING TANK—LULICH LANDSCAPING: Specht stated that this location does
not have very many alternatives, and a toilet is needed—Motion by
Specht to grant conditional use permit, 2nd by Boyle.  Discussion
followed:  Poe stated that Lulich has improved the property by putting
in a business.  The property is a great improvement when entering the
Town of Germantown.  Poe would like to see a provision put into the
variance:  That if a sewer is put within 500 feet of the property that
Lulich Landscaping, LLC would be required to hook up to the sewer;
that this holding tank could possibly be only a temporary situation. 
Specht agreed that is a fairly reasonably request.  Thompson also
agreed that this a reasonably request, but may create a problem if the
sewer has to cross the road.  Specht would like to know if the
variance goes with the property if sold.  Uphoff stated that a
conditional use permit would be needed and could deal with that then. 
Specht withdrew his motion.  Motion by Poe to approve variance as
requested with the condition that if the sewer runs adjacent to Lulich
Landscaping, LLC that this property would  be required to hook up to
the sewer within 6 months, 2nd by Boyle.  Motion Carried.

ADJOURN MEETING:  Motion by Specht to adjourn the special town board
meeting at 7:05p.m., 2nd by Gillespie.  Motion Carried. 

Chairman Jax declared the special town board meeting adjourned.
