Planning Commission Meeting August 11, 2009 Not approved yet 8/19,2009 Present: Chairman Specht, Margaret Miller, Audrey Scholl, Roger Bean, Jim Collis, Paul Merk, Michael Poe. Meeting called to order at 5:32 p.m. Roll call. All present and accounted for. Meeting has been properly posted timely at 4 locations. Recognize others present- Zoning Administrator- William Bruce. Minutes from July 14, 2009 were read. Corrections- Page 2- Rock Island, page 3 Pat not Par. Motion to approve the minutes with corrections was made by Michael Poe. Second by Paul Merk. Motion carried Chairman’s comments / Approve agenda- Chairman Specht- agenda seems appropriate. Michael Poe-Old Business: 15th Ave. Boat Landing- Question if the one on the north side. Dave Specht – right. Michael Poe- This was part of the original Copper Point plans. William Bruce – started by clear cutting brush. Michael Poe – they have graveled and sand sprayed. This is the first part of Copper Point and Pavloski’s were required to pave the road but not the landing itself. William Bruce discussed the shallowness of the boat landing area. Dave Specht- post signage- “No Parking: and “Boat Turn Around Area” . and “Public Parking” at the gravel.. Post signs and post public parking. There are 12 spaces car/ truck/ trailer like on the south side of the Little Yellow, and stripe it. William Bruce questioned if this needs Board approval? Michael Poe- No parking needs to go through the Town Board. Roger Bean questioned if no parking would be a general Town Ordinance or to that specific area? Tony Green is working with Bill Curran on an Ordinance that may help enforce this. Adjacent property owner reported the first week end a ½ dozen people used the area and it worked nice. After that they started parking all over and it made a mess. Dave Specht- We need to post. Michael Poe – “No Parking” has to have Board approval. Dave Specht would like that on the next Board Meeting Agenda. Roger Bean- discussed need enforcement with a penalty, if do not have ordinance, can’t enforce. Michael Poe- The Town is looking at that. Paul Merk questioned where placing the signs. Roger Bean- the State has requirements for signage. William Bruce- 2 signs for no parking between signs Dave Specht- 1 sign for Boat Trailer Turn Around. Roger Bean – 1 sign for public parking Dave Specht- put on next Board’s agenda. William Bruce -The second thing we are looking at tonight is requirements for future developments landscaping plans. Zoning Ordinance 22 Section 3.08 Par 5 (d) page 19. This was brought up because of lack of General Landscape plans for Rock Island. Michael Poe- 4 does not apply to landscape. #1, 2, 3 and 5 pertains to landscaping. Dave Specht- this would need to be written by the attorney and a Public Hearing is necessary for changes. William Bruce- if part of the ordinance- enforce it. Michael Poe- Paul Merk requested specific requirements. Dave Specht- comfortable if Planning Committee and Board are dealing with individually. Paul Merk – have concerns for future developments, if they know what we want- if clear cutting leave a natural buffer. The spirit of what we are trying to do. One solution does not cover everything. Dave Specht- process is determined at each location. Paul Merk – trying to prevent clear cutting and then turning into a PUD and then planting a buffer. Dave Specht discussed forestry projects, some clear cut up to the road. Michael Poe –nice to do one area to have to work off of. Paul Merk – when addressing the planned unit developments a goal should be to keep our township as natural as we can. Think of vacationing here and why we came. (Vacationers came here to get away of the way Town of Germantown is developing.) We need to keep looking natural. Margaret Miller – questioned if owned 215 acres and decide to clear cut shat happens. Stop them? Paul Merk- that is not what he is addressing. Trying for way to look natural when can. Audrey Scholl – Good thoughts. General Landscape treatments- be more specific. Berms- not all have but be more specific with landscape treatments. If we have something in place it is not as hard. Roger Bean- We need uniformity in decisions. Roger Bean presented an 8 page draft that is way beyond our needs but wants the rest of the Planning Commission to read and take from, cherry pick. Jim Collis – agree, need standards to follow- guideline like. Paul Merk – In the process do developers present the landscape plan in the pre-petition Plan? William Bruce- In the pre petition plan and then in the General Development Plan they have to be included. Paul Merk- it seems that case by case they are inconsistent. Michael Poe- the Town has allowed different things because of sewer and roads being provided. Planned Unit Developments (PUD’s) are a negotiation process. Roger discussed guidelines. William Bruce- recommends that we form a sub-committee to look at guidelines and bring back to the Planning Committee. Michael Poe- we have had many criticisms but seems many have the attitude of pull up the ladder and not let others do what we did, ½ acre lots o.k. for us. Roger Bean – Land Use Plan is a guideline. Timbering, MFL, Plans with the State don’t say leave a buffer. Different plans for different projects. Use guidelines and then argue the specifics. Dave Specht- life cycle of trees, different stages, different looks. Believes each case is individual. Not required to do the same in the next PUD. Audrey Scholl –need to reinforce- Paul Merk had good ideas. Need to be a little more specific. Roger Bean- we have our reading material. William Bruce- guidelines are just that. Paul Merk- establish spirit of what we want. Volunteers for committee for guidelines for landscaping requirements. Paul Merk, Roger Bean, Audrey Scholl Michael Poe- discuss many types of developments, if lock into 3 acre model, trees, roads, benefits to and from PUD’s., acres DNR has acquired, need to keep the balance, there are benefits to clustering. Paul Merk- trying to establish landscaping guidelines. Audrey Scholl # 4 addresses PUD’s (last month’s agenda) Petitions received- 36 people were against PUD’s. That is a small percentage against. Paul Merk- interested in # or % of PUD’s compared to not PUD area. Dave Specht – discussed working 2 to 3 years on our Comprehensive Plan. In 1964 why did people come here? Michael Poe- In 1964 96 people were residents. Dave Specht – In 1970 the DNR began aggressively cleaning up the river. The Comprehensive Plan has more places to deal with the issues. #3 MVP District – William Bruce passed out the newest list of business occupants. Dave Specht- decide specifically if coming up with District. William Bruce – Can do by amending types of zoning- now have ARO, Town Center, Commercial, Recreational, Development, Shoreland Overlay and PUD. Create in 3.01 to include industry, 3.09 Language, what is an industrial district? or amend Commercial to include Commercial/ Industrial. Dave Specht – specific issue- would we prefer these to be permitted uses? Michael Poe – downside is nothing is allowed in conditional use. Dave Specht- if conditional use a lot is irrelevant, if expand more than 15% of the building then conditional use. Would we prefer these to be permitted uses? Easier than Commercial District / Conditional Use/ Commercial permitted in Industrial. Roger Bean – deal with MVP separately and leave everything else alone. Question if any feedback from MVP. William Bruce- none seen. Roger Bean- Incubator District- don’t like to commingle. Incubator allows for growth and flexibility. William Bruce- create new District –Commercial / Industrial Mixed Use. Roger Bean- define parameters of area talking about, mixed commercial combines old Best Power. Do not want conditional use for each business. William Bruce- we have updated list of people need on list- activity, phone number. Roger Bean- form a sub committee – volunteers- Dave Specht, Michael Poe, Jim Collis. Mixed use/ Commercial. Paul Merk invited Margaret Mille to join the landscape committee. She agreed. Chairman for Landscape Committee Paul Merk, Chairman for Mixed Commercial Jim Collis. New Business: William Bruce reported that Half Moon Bay Association will be looking to change their PUD. Half Moon Bay condo Assoc. wants to subdivide existing lots so each building has its own lot.. On the next agenda we will have to decide if this is a major or minor change to the PUD. William Bruce also reported that the lots will be approximately ¾ acre. Dave Specht- just individual units on each lot. Michael Poe asked where we are on the Fence ordinance. William Bruce reported that it is not finalized and we are waiting to hear back from Attorney. Send to Bill Curran to include into Zoning Ordinance, into definition of fence. Public Comments-Andy Suehs- Commends Paul Merk for suggestions for guidelines. Dale Simonson Buckhorn Acres thank you for your concern and getting the berm reduced for Rock Island. It is appreciated . Irene Boudreau agrees.
