TOWN OF Germantown Planning Committee Meeting February 9, 2011 Meeting called to order at 5:30 p.m. by Chairman Specht. Roll cal: Chairman Specht- present, Jim Collis-present, Roger Bean-present, Audrey Scholl-present, J.K. Walsh- present, George Vukich- present. Quorum present. Others present- Zoning Administrator William Bruce Zoning Administrator William Bruce reported that the meeting had been properly posted at Buckhorn Store, Germantown Junction Store, Town Hall and the Landing. Minutes of January 11, 2011 meeting were read. Motion to approve the minutes was made by Jim Collis, Second Audrey Scholl. Motion carried. Chairman Specht had no comments and approved the agenda in any order. NEW BUSINESS: Chairman Specht acknowledged the resignation of Michael Poe from the Planning Commission. His resignation was accepted at the Town Board Meeting. Chairman Specht would like no new appointments until after the election in April. Burning Ordinance William Bruce reminded the Committee that they are working with Emergency Management’s Burning Ordinance, Section 9. The outdoor woodburner question remains- setting up distances. Chairman Specht- Ppractically thinking, this is not an option for the part time residents. He is willing to listen to proposals. Jim Collis- there were concerns from a person in the audience, doing nothing has repercussions. Chairman Specht- 1 resident should not be a driving force behind making ordinances. There have been no incidents or complaints. Has not seen any issue with them. Audrey Scholl- have noticed different clouds they make, some days hang closer to ground. William Bruce-inversion clouds hang Chairman Specht- his regular fire place burns the same. William Bruce- has one comment- what can be burned? That can be covered by the State Law. Chairman Specht reported a conversation he had with a person from the DNR and their thought was if you are concerned with emissions look at the burning barrels.. William Bruce- outdoor burning- look at in accordance with what law and in what district would you want it. 9.1- scratch it. 9.2 changes to 9.1 9.3 at least 50 feet from structures not on same property. Or 50 feet from any building or 35 nearest building. Some of the developments already prohibit this. Discussion on ½ acre lots. Make 50 ft from nearest building not on same property. 9.4- now 9.3 discuss 5 ft above roof line, higher than next building, guide wires, manufacturers recommendation. George Vukich discussed ordinance he worked on elsewhere- went by population, had to be higher than your rooftop. Looking at the safety and welfare of the citizens on a whole. There is no magic number. William Bruce- height recommended by the manufacturer. Chairman Specht- most are about 12 ft high. Roger Bean- have seen not higher than the building housing the wood burner. Minimum 5 to 6 ft above the roof of the building housing the burner. William Bruce- at least 15 ft. Audrey Scholl- one she has seen had no extension. Chairman Specht- should not be an issue- once people find out how much wood they burn and getting up early to go out and start the fire. Can eliminate 9.5. Roger Bean- discussed clean wood- should have clean wood as defined in 4.2 and State Statutes. Bring back after written. George Vukich- questioned ones in existence, if any would be grandfathered in? Update On Zoning Ordinance 3.03 3.04. Haven’t heard from Ray Feldman, he is working on definitions. Dave Specht discussed keeping the two sections separate, changing in the definitions. Felt it was apparent that people wanted to keep the Town Center. Roger Bean- Looking to revise 3.03 and 3.04 and keeping the Town Center. Chairman Specht-changes are needed. Roger Bean- definitions clean it up but there are other things. William Bruce- modify what we have, correspond with definitions, April 09 changes. Roger Bean- it seemed that 2 people wanted to retain the Town Center. Two problems- out building without residence and trailers. If definitions are updated, Town Center stays and Ordinance remains the same. William Bruce- correct overlapping language. Chairman Specht made reference to ATV’s. William Bruce- Put same language in both and leave Town Center. Chairman Specht- discuss building bigger building and ARO. Roger Bean- can put that back in the same and leave the Town Center. Chairman Specht-Need to take action and move on. If want to revisit do now. William Bruce will get a copy of the last draft to members of the Committee. Thank you to Roger Bean- your work is appreciated. Public comments –none William Bruce questioned where we are on MVP. Chairman Specht- We need to enact. Request William Bruce to send copies to MVP and the Planning Commission so all have the same copy. J. K. Walsh questioned what is the issue. Chairman Specht- the Town needs to know what is going on up there. Roger Bean- they are not in compliance but in violation of the Town Zoning Ordinance. Chairman Specht- it has been at least six months since they responded. William Bruce- they were referring it to a new attorney. Chairman Specht- When we put this on the agenda we need to let them know. Roger Bean- too much knee jerk reaction, one or two people complain and laws change. William Bruce- DNR Wildfire Protection Plan is near completion. Next meeting March 9, 2011 at 5:30. Motion to adjourn was made by Jim Collis. Second by J. K. Walsh.
