Town of Germantown Planning Committee Meeting June 23, 2009 Members Present: Chairman Specht, Jim Collis, Margaret Miller, Paul Merk, Michael Poe, Audrey Scholl, Zoning Administrator William Bruce, Attorney Bill Curran and Betty Manson Meeting Called to order at 5:35 p.m. Roll call vote- Members Present: Chairman Specht, Jim Collis, Margaret Miller, Paul Merk, Michael Poe, Audrey Scholl. Absent Roger Bean. Quorum present. Others present: Zoning Administrator William Bruce, Attorney Bill Curran and Betty Manson Chair recognized Pat Pavloski, Chris Renner and Matt Morrow. Verification of proper posting in three places in the Town reported by Mrs. Manson. Minutes from May 27 and June 9, 2009 were read. Chairman Specht called for revisions and correction. Motion to approve the minutes from May 27 and June 9 was made by Jim Collis. Seconded Margaret Miller. Motion carried. Chairpersons comments – Approve Agenda – Chairman Specht read the agenda. Motion made by Michael Poe to approve the agenda. Will follow as presented. Seconded by Audrey Scholl. Motion carried. Old Business 1) Recommendation for Town Board regarding 3rd Addition to Copper Point. William Bruce reported that changes were for lot configuration including lots 25, 26 and 27 change to 4 lots (+1), lots 31 thru 41 into 14 lots (+3), lots 55 thru 60 change to 8 lots (+2), Lots 81 and 82 with lot 83 (-2), Lots 61 – 63 with 62 (-2), Lots 76 thru 77 change to lot 75 (-2) Plus six lots, minus six lots. Same density as original plan. Changes to General Development Plan. May 27 we took a vote that this was a minor change, subject to Larry Koopman’s approval. Mr. Bruce reported - Mr. Koopman did not write a formal letter but verbally approved. Chairman Specht – Are these changes incorporated into the Preliminary and Final Plat for the Third Addition to Copper Point? Michael Poe made a motion to approve changes to 3rd Addition to Copper Point and approve the Preliminary and Final Plats. Second Jim Collis. Motion carried Chairman Specht – We will review the landscape plans for Rock Island Lake. Chris Renner , drafted the plan, explained the row of trees along the lot lines and lots. Michael Poe- What kind of trees? Mr. Pavloski- White Pines, seedlings, 3ft to 12ft. Michael Poe – Between lot lines what kinds of trees? Chris Renner- Seedlings , White Pine. Michael Poe – Around the parameter, first row? Mr. Pavloski - Red Pine, Jack Pine, White Pine – 5 to 20 ft. Lot lines the same size and row next to the road same thing. Michael Poe – glad to see not all seedlings. What is on the ground between the trees? Mr. Pavloski – prairie grasses – creeping red respie, rye, they have growth power. Getting up higher is chewing fescue, roots go down 2 ft. Helps hold down erosion. Blue grass would not stand a chance. Michael Poe – Will it be mowed? Mr. Pavloski –mowing to start will establish stronger roots but will grow wild. Michael Poe – will the lots have sprayed grass? Mr. Pavloski – we will grade –when first started used farm cedar, poplar with paper, wood chips- holds moisture and grass in place. GPS allows us to do in sections. Dark green-open space, light color beaches. A Jack Pine in the woods is a stick but will be able to move over as we go and won’t have empty waste land problem. Beach will be same, working with the DNR. It has a mini berm instead of flat so it will infiltrate thru the beach instead of running down the beach. Recorder turned on 5:55 p.m. Michael Poe discussed the acreage of Castle Rock Island. Beginning plans had big rock boulders on the island. Mr. Pavloski believes approximately 36 acres Mr. Bruce- The total project area is 120 acres. Matt Morrow – 36.7 acres lake area. Michael Poe questioned the depth of the lake, 13th ft? Mr. Pavloski – it will be deeper in holes. Mr. Michael Poe discussed the elevation lines and high water mark. Will this be 20 ft in places? Mr. Pavloski – yes. Will be above Castle Rock Lake. Paul Merk – The berm is the biggest concern of neighbors. Where it borders on neighbors, how will you hide it? Matt Morrow – berm is 11ft in spots. Paul Merk - Trees between 5 and 10 ft. ? Mr. Pavloski – approx 12 ft. Paul Merk – will this hide the berm? Mr. Pavloski – yes, 1st five years are slow then they grow quickly if spaced properly. Audrey Scholl – would like to comment on the berms not comfortable with 11ft and 12 ft berms. Would like to see more continuity working in with neighborhood. Would also like to see work with existing topography. Could we reduce or do we have to have the berm? Is it possible to not have that? Mr. Pavloski – Impossible- would have to have an opening mining permit and it would not be approved. Michael Poe – looking at the peak. That looks like a sharp peak. Would be better if 4 ft less. That is troubling. Matt Morrow- The drawing is exaggerated and they will not be very sharp. They look more like the bottom drawing. Mr. Pavloski - Discuss pitch 5/1. Clearwater is 3/1. It is 2 times flatter. 11’ to 12’ in spots along the road. There is no berm like this one to compare to in the Town with the proximity to homes. If within 300 ft to residence it is o.k. If within 100 ft then a concern. There is road – ditch – berm – road – residence. Dave – how high by west of lake, 20 ft.? Matt Morrow – closer to 14 ft or 16 ft. 5 ft less? Farther away – less slope. Mr. Specht – there is a designed catch basin so no runoff, no excess H2O running unto road. Protect culvert, covered with fabric. As berm, at Clearwater, 15th Ave. East side of Clearwater 6 -1 ratio, about same size-no peak. Mr. Michael Poe – Clearwater peak is so steep Mr. Pavloski – can’t plant seedlings there. Totally different design. Mr. Specht – designed catch basin, no run off., no excess water to adjacent road. Mr. Poe – planting goes a long way and change of slope, height, perameter significant difference than what thought. Like to see more natural. Mr. Pavloski – First have to mow no desire to cut for years, just to get roots deeper. Mr. Specht called for questions- Chairman Specht adjourned to later date the discussion on Rock Island Lake proposal. On agenda next month discussion and possible action for Rock Island Lake. Mr. Poe – conditions will also be added at that time. Public comment - Mr. Borgwardt questioned the boat landing. Couldn’t turn around, unusable for the general public. Can we do something? Mr. Specht – drop off information to Betty for discussion at a meeting. Contact Mr. Bruce to see the drawing of what is proposed. Mrs. Boudreau – questioned if this was going to be farm land or if it was development. Mr. Pavloski – it is his land, do not know. Jill McEachron has looked at Hidden Bay and they have no berms and 3 acre lots. Why are there no berms there? Why not get a mining permit? George Koziaites 1) berm east side south west– elevated like on south side or lower Mr. Pavloski –Retention basin/ open space, green space. 2) Beach Court – house, pole barn will that come off the property? Mr. Pavloski –Yes 3) City water is non existent – how will the wells effect the local wells. Mr. Specht – This won’t effect the water table. Discuss down 15th Ave and the Sanitary District. Will be able to hook up if septic fails 4) will the lake have public access? Mr. Pavloski – not public. Question about green spots on map – islands with boulders on top. Spring when the water table is the highest the lake will be 20 ft. Diane Pett – unhappy with the berms. Who will do maintenance? Replace dead trees? Feels the project is un-neighborly. Andy Suehs – When was this planted in corn? Doesn’t it need to be rezoned? When surveyed the people in Germantown at 70 % felt the Town should preserve the woodlands. Mr. Cavallero – explained background, feels has provided input and has professional knowledge-he speaking as an adjacent land owner. Shared letter received from Pavloski’s. Landscape plans are good step forward Attorney Curran- Board has nothing to do with bulling tactics, we want free speech, if there is the slightest chilling effect we do not condone. Mr. Biederman noticed comment “that is my land and I can do what I want” Comments from Planning Commission members Michael Poe 1) learned about deciduous trees and the area soil. Advised not to use in this area. Oak wilt – bad problem. 2.) If we look at all the developments 3 acre v/s small lots- if 3 acre six times more acreage is being developed. Preserves more land completely being developed. 3.) Troubled that Power Company chose to sell all the land all at once. A 10 to 20 year period would have been more natural. We should contact FERC to become an “interested party”. Question how this will effect the tax rates. Chairman Specht- Taxes are not within the power of the Planning Commission. Mr. Merk –Discuss - object as whole, how it looks now, trees, scattered, road, trees. Mr. Simonson expressed concerns previously-now with the map how does it look. Mr. Simonson – appreciated landscaping plan personally finds it acceptable but also received a letter and would prefer to not give an opinion. Mr. Borgwardt – 11 ft seems out of bounds to him. Paul Merk had people raise hands if they can live with or are dead set against. Attorney Curran – The General Development Plan and the Specific Implementation Plan was approved, and that changed the zoning to Planned Unit Development. Does not see any violation in planting vegetation. Chris Renner mentioned the time line has them doing this in phases. Chairman Specht – Next meeting will be before the Board meeting July 14 5:30 p.m.and we will discuss and take possible action on General Development Plan and Specific Implementation Plan for Rock Island Lake.
