Town of Germantown Planning Committee Meeting June 9, 2009 Members present: Chairman Specht, Margaret Miller, Roger Bean, Audrey Scholl, Jim Collis, Michael Poe and Paul Merk, Zoning Administrator William Bruce, Attorney William Curran Guest Chris Renner Meeting called to order at 5:30 p.m. by Chairman Specht. Roll Call- all present and accounted for. Quorum present Notice and agenda posted in three places and notice published. Minutes were read. Corrections - Mr. Bean missing from the minutes is the closing of the Public Hearing. Michael Poe made corrections that are in the draft minutes, a lower case w in wildlife, PUD not Pull and new wording on page three in the current copy. Motion made by Mr. Bean to approve the minutes as amended with the four comments. Seconded - Michael Poe. Motion carried. CHAIRPERSONS COMMENTS - approve agenda - no old business on the agenda - This meeting is to discuss adding the industrial district to our ordinance. - Mr. De Pres will be speaking Public Comments Member Comments and setting a meeting date. Audience question Where is the Industrial Complex. Mr. Specht the old Best Power. Mr. Du Pris and Mr. Unworth from M.P. are here to discuss plans for the new district. Dave Specht point in time- 1989 when our ordinance was adopted Best Power was grandfathered in as a use, just industrial use which is conditional use. We are looking at primarily because of fire, public safety. We need to change to include business as it is currently run. Concerns are fire, public safety, police, services. Starting from scratch. Now every new business is under conditional use and the plan committee should vote to approve. We would like to streamline and simplify but still know what is going on.. Question , audience, how is more building going to help the small guy? Chairman Specht- the building is already there. Michael Poe We cant vary from the agenda by State Statutes. We are not able to respond to questions on developments at this time. Mr. Bruce We need to know what businesses are in the complex today and what comes in the future. Mr. DuPris Mr. Miller was in discussions with us on how we utilized the facility., we are not adding to the building, not near capacity, we are not talking about taking trees down and not adding to urban sprall. We share the sense and reason, anyone can come to the facility and we will tell them every business there, discuss parking issues, we are transparent. We can give a list, who, what, used for, administration, small wares, small manufacturing. We plan like entrepreneurs plan. We have planning, light manufacturing. As a point of clarification would like to see conditional use permit, what the planning committee wants the company will provide. Would like to know what is being proposed political? Expansion? We have no intent of expanding as are running at half capacity, no building in the near future. Mr. Bruce- the committee thought instead of changing the conditional use each time, we could make a district for what is there, may need new conditional use if 25/ 50 employees. Mr. DePres- if renting space to bio diesel we would need to talk to more people state / fed/ fire etc. Mr. Bean if we like the profile coming in would just need to know, could make a condition for going through a process based on fire and safety. Mr. DuPris we dont want the planning committee to be able to veto a tenent. Mr. Bruce the original conditional use is no longer applicable. Michael Poe Example pest control example whether by conditional use or zoning ordinance it meets some criteria. The process has grown. Mr. DuPris the bug lady had a natural product. Chairman Specht in favor of the permitting process as opposed to conditional use. Mr. Bean looking at administrative procedure- others have to apply for conditional use and need to go through the process. We are looking for a balance to correct. Looking for a way to work together. Mr. Michael Poe We are trying to be positive and move forward. Looking to help grow. Mr. Du Pris would like to see when you have a draft so we can have input. Mr. Bruce first we need contact information with a brief description. Would like a process that can accommodate everyones needs. Mr. Bean we need to look at the ordinance and what is the normal requirements and then try to think what would be a better process. Michael Poe We would like names, activities, contacts to help us get a better picture. Bill Curran The Town needs to be consistent and treat everyone in Commercial the same. First- The Town Commercial Zoning call for a condition use permit. When Best Power came in was Light Industry and they didnt think that would change. There are definition problems that need to be addressed to handle consistently. We need to beef up the definition of light industry, the board needs to look over what we have for mechanisms to cover. Second Zoning Ordinance has different controls for uses. If commercial / new owners / new process/ - Every new use starts a new permit process. Individual sites need to look at. Many things addressed including traffic flow set backs etc. In your situation, tenants, zoning , burden for the things missing as collecting the facts would like to put on you. This is yet to be determined. Mr. Du P ris We have a large turnover. Mr. Curran- Possibly could keep generic, keep track of what is going on. Happy to sit down with a draft. Mr. Specht This is our first meeting addressing this- we are looking at different ideas. We do not want to control but need to know. There are rules on the book that do not work for this situation. Mr. Michael Poe How many businesses? Mr. Du Pris 28 to 30 , 1-2 person operations. We provide incubator operations and have opened a lab service recently. Chairman Specht that will be addressed later on the agenda. Examples one business sells prepared lubricants, they are in every two weeks. D.A.T. has 80,000 sq. ft. Wire harnesses. Offer support and collaborative services/ resale shop with disabilities. There is a mix of different stuff and we take care of the facility. Approx. 200 people work there now. Examples of others Ralph Hammel in the Rapids and John Hayes- Community Action in the Dells. Mr. Michael Poe- Questioned if retail types of business. Mr. Du Pris Just the resale shop. Supplies are trucked and motor freighted in. Mr. Michael Poe- there are two types of uses at this time. We want to be able to accommodate. Attachments for this zoning have been brought up for some time now. Roger Bean was excused for another meeting. Mr. Bill Bruce Thank you to Mr. Du Pris and Mr. Unworth for coming. Margaret Miller brought in a packet of information for light industry for the planning committee to look over. Mr. Specht Rock Island will be discussed at the next meeting. We will set the date tonight. We have received additional information including the landscape plan and elevations, this information has been passed out to the members. Public Comments- Mr. Biederman questioned if the Planning Commission has received a letter pertaining the berms and how much input comes from the Township? Guest Do you feel we have enough berms and water puddles in Germantown. Chairman Specht- The developments are not on the agenda tonight. Question turning in to corn fields. Mr. Michael Poe this will be discussed at a later date. We can not have a debate. Mr. Specht- will be discussed at the next meeting. Mr. Michael Poe This is not an open forum. Mr. Biederman- this is a waste of my time and yours. Mr. Suehs when is next meeting date for Rock Island Lake? Chairman Specht that will be addressed later on the agenda. Commission Members comments- Next meeting date set June 23rd, 2009 at 5:30 p.m.. On the agenda will be Rock Island Lake Development. Will need to contact John Haye to see how others have addressed the zoning so we are not starting from scratch. Mr. Curran what would you do in business office suite? Chairman Specht we need to keep this straight, forward and simple. See if a new district answers our needs. Mr. Michael Poe Motion to adjourn. Seconded by Audrey Scholl. Motion carried.
