Town of Germantown Planning Commission Meeting May 13, 2009 Members Present: Roger Bean, Jim Collis, Paul Merk, Audrey Scholl, Chairman Dave Specht, Michael Poe, Margaret Miller, Zoning Administrator William Bruce, Marion Uphoff Developers Brad Pavloski, Pat Pavloski, Chris Renner and Matt Morrow Meeting was called to order by Chairman Specht at 6:03 p.m. Roll call. All present and accounted for Meeting was properly posted in paper and 3 locations. Agenda was posted at 3 locations Request audience to give name clearly if speaking for the record. Minutes from April 22 and May 9 were read. Mr. Bruce would like the Commission to have time to go over and approve at the next meeting. Mr. Specht-Tonight is for The Specific Implementation Plan and General Development Plan for Rock Island Lake and the Specific Implementation Plan for the 1st addition to Copper Point. Mr. Bruce- There was a Public Hearing for Rock Island Lake and we hope to address those concerns and letters received Mr. Collis- feedback he has received is about the drainage. Mr. Koopman asked Mr. Morrow to clarify. Mr. Morrow- explained how water will drain into pond. Road berm will be 7 to 11 ft high and built so drainage will run to the retention basin and infiltrate into the ground. Discussed retention ponds, ditches, slopes of the different sides of the project. Mr. Morrow checked topography maps again today. The intent is to retain water inside the project. There will be some runoff but aim to keep in site. Mr. Michael Poe questioned water on 32nd and 16th after last rain. Mr. Morrow-explained reversing the ditches to drain properly. Mr. Koopman- questioned if will reroute to ditches. Mr. Michael Poe- questioned if across to Clearwater or across to 15th. Ό mile area. Pat Pavloski- re-grade those. Previously ground was frozen and there was a hugh storm. When ground was frozen and ice melting noticed the ends of the culverts were covered to keep debris out. Took off the covering and it let the water move. Mr. Larry Koopman- Questioned general flow, high end and low end. Mr. Matt Morrow- showed on map how low end flows left to right. Mr. Larry Koopman commented on how runs into lake. Questioned not draining now to north west sides and retention areas picking it up. Mr. Matt Morrow-yes, explained 6/1 and 5/1 slopes Mr. Larry Koopman discussed contours to property lines? Trees? Mr. Pat Pavloski- No jack pine or dead oaks.. discussed grass and trees and their planting of trees this year. 23,000 seedlings planted. Mr. Michael Poe questioned if landscape plans have been drawn at this time. Would like to see a long range plan, what is it going to look like? Mr. Dave Specht- discussed how Stonegate had looked with excess piles of sand piled high. South west and north slopes are steep. Are there calculations for how much excess sand or material? Mr. Pat Pavloski- Project will take a long time. The North corner is stabilized. Discuss berms and elevation of roads. Mr. Dave Specht- Stonegate is about 10 ft above area, is Clearwater a little higher? Concerns on the edges, road level, great amount of sand. Mr. Pat Pavloski- That is put there because of the mess on the other side of it. Mr. Dave Specht- try not to have steep slope. Mr. Michael Poe- Discussed Out Lot 13, buffering planting without drainage. Could use grass seedlings and trees. Edges of ditches have no drains to retention areas. How planted? South edge. Mr. Pat Pavloski- Grass came in, pointless to do anything- native grasses. Mr. Dave Specht-black dirt? This development is different as there is development on 3 sides. Mr. Michael Poe- Unlike others as have only had developments on one side. Question wildlife areas west of 15th Juneau County owned land, North- State and D.N.R. owned lands in the Wildlife area. D.N.R has recently acquired land, notified the Town of 200 acres . Mr. Chris Renner- 935 acres recently bought by the D.N.R. Mr. Roger Bean-Questioned if the Sanitary District questions have been cleared up and will property adjacent be required to hook up. Mr. William Bruce- spoke with State personnel, if adjacent to the line and in the boundaries would have to hook up. Cost is actually cheaper than rebuilding a septic system. Discuss Sanitary District Ordinance. Mrs. Tracy Tomaloff from the Sanitary District pointed out you would have to be adjacent to and WITHIN THE BOUNDARIES to be required to hook up. The area could partition the Sanitary District and if 51% wanted to be in the District they would be a part. You are not forced nor required if not in the boundary. Mr. Roger Bean- Get copies of the Sanitary District Boundary Maps. Mrs. Audrey Scholl- Will the lots on 15th and 32nd have driveways on those roads? Yes Questioned why so many lots when houses not being built? Mr. Brad Pavloski- has been asked why not force people to build when they buy? They are in the business of selling lots and most are sold to people out of town. 75 to 80 have been sold. We are not builders of homes and do not require to build in a certain amount of time. Mr. Michael Poe- In older developments- Half Moon Bay, ODells Bay and Three Rivers- there are still empty lots. Mr. Brad Pavloski Since 2007 sold 80 to 82 lots over all. 42 homes are being built. More on the less expensive lots. Total build out time is hard to tell. Lots are selling- 2007 80 lots, 2008 - 55 to 60 lots. Mr. Paul Merk- discussed PUDs and buffering- how it fits in for density, how many. Mr. William Bruce Smart Growth identified areas nothing is etched in stone. PUDs - all meet or exceed open space. Mr. Brad Pavloski along lines of Smart Growth. 935 acres of area labeled residential has been turned over to the State for wildlife areas. Mr. Dave Specht- When looking at the Comprehensive Plan, page 65 no where does it specify #s. Mr.Paul Merk - First developments were received well. Now changed. This is first time a development is surrounded by developments. Have to be sensitive. There is nothing to stop anyone from buying up property, making bearms, clear cutting trees. Need what is the long term plan, what is good for everyone. What to expect. Should be planning, do we want more lots? Discuss equalized values. More value, more percentage of the share to pay for taxes. Discuss lakes filled and maintained. They are above and dug deep. There should be no maintenance for 100 years because they are dug deep. The problems are in the shallow dug ones. Mr. Pat Pavloski blue dye is added to reflect the sun. No phosphorous. It takes a long time to landscape a 160 acres. When building get plans for landscaping with the plans for the house. Have a 80 tree spade moving trees. With the ponds have to cut the trees. Mr. Michael Poe- Most of the criticism of this project focuses on the loss of forest and wildlife habitat. Should also be concerned with the impact on Castle Rock Lake as a resource. With the existence of ponds taking 30 to 50 % of the use off the lake. Less on the lake, less pressure. Mr. Brad Pavloski- he and his brother could have built on the lake but chose on a pond. Mr. Jim Collis - discuss water table and digging down. Mr. Michael Poe Pumping water in? Mr. Chris Renner no. Elevation of the lake coincides with level of Castle Rock Lake.. If Castle Rock is low, man made lakes low. Match the changes in the lake. If wells fail they will have been effected by Castle Rock Lake if very low. Public Comments: Mrs. Boudreau Will all be surrounded by Bearms? We are totally closed in on three sides. How high? Mr. Pat Pavloski explained that air flow will be better with the trees down. The area will be totally finished. Mr. Simonson has pictures of Clearwater. As a representative of the Buckhorn Acres Property Owners Assoc the big high berms are unacceptable. Stonegate is beautiful. The area behind the shop is gravel. With this height all you see is berms of grass and trees. 11 ft berms are unacceptable. Paul Merk Questioned if would feel better if more trees were planted. Mr. Simonson- discussed talks of a 100 ft buffer. If there were more trees they would be happier. The people he has talked to in Wildlife Estates are petrified.. Mr. Simonson supports the project but people are saying the Planning is in the pocket of the developers. Mr. Pavloski that is slander. Mr. Michael Poe takes exception to that statement. The Planning Commission has been honest. Mr. Pavloski pointed out that Mr. Collis bought a lot from them and paid more than others. If given the discount others received would have looked bad. So he ended up paying more. Dave Specht - we need to stay on the issue tonight. Andy Suehs- consider Paul Merks remarks and what is the master plan. Now hugh hunks of land are being developed. Mrs. Mazzoni discussed her project and how they preserved all the trees when they did it. Mr. Cavallero discussed a letter he has sent. He is not negative about development, just the inconsistency and unfinished / incomplete projects. Discussed a Utility Plan-grades and slopes to preserve, sticking to the grading plan and having a landscape plan. Need to know what the plan is and what will be planted. This has a bigger effect on some but would like to see a formal landscape plan. Question status of Clearwater Lake. Pat Pavloski it is a cornfield this year, has been moth balled for now. Pictures presented of Clearwater Lake site. Two different standards compared to Waterstone. Brad Pavloski Clearwater question if paved, water in. project is not complete. Pat Pavloski have worked for years with the Committee and we always do what we say. All have been landscaped perfectly. If there is a problem later we go back and fix it. Michael Poe- why does it look like it does? Pat Pavloski- it is not done. It was seeded late in the year, part grew but ran out of time. Mr. Paul Merk Question time lines. Mr. Pat Pavloski Rain slowed up last year. Mr. Paul Merk Dave Specht has been , start to finish, three years. Mr. Pavloski some projects take 5 to 7 years. Mr. Paul Merk So you havent been in violation of any time lines? Audience- are we going to be forced out? We have a mobile home and will that have to go? Mr. Dave Specht- that has NEVER been brought up for discussion. We need to move on to the proposed changes to the 1st addition of Copper Point. We will meet in another two weeks to look at a final on Rock Island Lake. Mr. Bruce requested smaller maps from MSA. Mr. Dave Specht In general explain if The changes are minor or major. If major it will need a public hearing.
